Please read these Terms and Conditions carefully before using our Service.

Words with initial capitalization have meanings defined under these Terms. These definitions apply whether singular or plural.
Definitions

Acknowledgment
These Terms govern your use of the Service and form an agreement between You and the Company. Your use of the Service signifies your acceptance of these Terms and our Privacy Policy.
You must be at least 18 years old to use the Service.
Important Service Conditions
Physician Review Required
All kits that contain prescription medications undergo mandatory clinical review. A licensed physician must approve every order before fulfillment. No prescription medication is ever dispensed without physician authorization and pharmacy review.
State Eligibility
We serve all 50 U.S. states and Washington, D.C. Fulfillment is subject to verification of physician and pharmacy licensure for the destination state. If a regulatory issue prevents fulfillment, the order will be cancelled and refunded.
Payment Processing and Refunds
Payment is collected at checkout. If a physician does not approve your order, or if fulfillment cannot proceed safely or legally, the order is cancelled and refunded immediately. Refunds typically appear in 2–5 business days.
Not a Substitute for Medical Care
Our Service does not replace in-person medical care. If your symptoms worsen or new symptoms appear, seek medical attention or emergency services immediately.
No Stockpiling
You may not purchase, retain, or use medications from our kits for the purpose of stockpiling or long-term accumulation. Medications are dispensed only for clinically appropriate indications determined by a physician.
Placing Orders for Goods
By placing an Order, you warrant that you are capable of entering into binding contracts.
Your Information
To place an Order, you may need to provide accurate information including name, email, phone number, payment information, billing address, and shipping address. You authorize Us to share this information with payment processors solely to complete your Order.
Order Cancellation
We may cancel an Order for reasons including:

Errors in description or pricing

Safety or compliance concerns
Orders not approved by a physician are refunded.
Order Cancellation Rights
Customer-initiated cancellations are generally not permitted after checkout. However, if your order cannot be fulfilled safely, legally, or with physician approval, your order will be cancelled and refunded.
Availability, Errors, and Inaccuracies
We strive to keep our product information current but do not guarantee complete accuracy. We may revise offerings or correct errors at any time.
Prices Policy
Prices may be modified at any time before acceptance of an Order. If outside factors affect pricing after acceptance, you may cancel the Order.
Payments
All Goods require full payment at checkout. Payment authorization must be received from your card issuer. We are not responsible for delays or failures caused by payment authorization issues.
Intellectual Property
All Service content remains the exclusive property of the Company or its licensors.

Termination
We may suspend or terminate access immediately for violation of these Terms.
Limitation of Liability
Our liability is limited to the amount paid by You for the Service or $100 if no purchase has been made.
“AS IS” Disclaimer
The Service is provided without warranties of any kind.
Governing Law
These Terms are governed by Delaware law, excluding its conflict-of-law rules.
Dispute Resolution
You agree to attempt informal resolution before pursuing any formal dispute.
EU Users
EU consumers retain rights required under the laws of their residence.
U.S. Government Use
Our Service is a “Commercial Item” under 48 C.F.R. §2.101.
U.S. Legal Compliance
You warrant that you are not located in an embargoed or terrorist-designated country and are not on any restricted party list.
Severability and Waiver
If a provision is invalid, remaining provisions remain enforceable. Failure to enforce a right is not a waiver.
Translation
If translations exist, the English version prevails.
Changes to Terms
We may revise these Terms at any time. Continued use after revisions signifies acceptance.

Affiliate and Influencer Program Terms
Affiliate and Influencer Program Terms
These Affiliate and Influencer Program Terms (“Affiliate Terms”) apply to any individual or entity (“Affiliate”) who participates in the Contingency Medical Affiliate, Ambassador, or Influencer Program. Participation in the program signifies acceptance of these Terms.
1. Compliance With Laws and Policies
Affiliates must comply with all applicable:

Federal, state, and local laws

FDA and FTC advertising rules

LegitScript Healthcare Merchant Certification Standards

Contingency Medical’s Marketing & Messaging Guidelines
Noncompliance may result in immediate removal and forfeiture of commissions.
2. Prohibited Language and Conduct
Affiliates may not use language that promotes or implies:

Stockpiling antibiotics
-
Hoarding medications
-
Prepper or survivalist framing
-
Using medications without physician review
-
Purchasing kits “just in case” without medical indication
Affiliates must not make medical claims or guarantee treatment outcomes.
3. Required Disclosures
Affiliates must:

Use FTC-compliant disclosures such as “#ad” or “paid partnership”

Communicate that physician review is required for all kits
-
Avoid implying that prescription medications are casual or elective
4. Content Review and Removal
We may request removal or revision of Affiliate content. Affiliates must comply within 72 hours. We may remove or suspend Affiliates who do not meet compliance standards.
5. Termination
We may terminate or suspend an Affiliate immediately for noncompliance. Upon termination, the Affiliate must remove all Contingency Medical promotional content and forfeits unpaid commissions related to the violation.
6. Indemnification
Affiliates agree to indemnify Contingency Medical for damages arising from noncompliant advertising, violations of law, or breaches of these Affiliate Terms.
7. No Medical Advice
Affiliates may not provide medical, diagnostic, or treatment advice in any content.
8. Modifications
We may modify these Affiliate Terms at any time. Continued participation after updates constitutes acceptance.
